Regulatory Landscape Overview

India's skilling sector sits at the intersection of multiple regulatory bodies. Unlike higher education (UGC-regulated), vocational training has a more fragmented but increasingly structured framework under NCVET (National Council for Vocational Education and Training, established 2018).

Phase 1: Immediate (Month 1–12)

NCVET Recognition

  • What: Register as an Awarding Body (AB) or Assessment Body under NCVET
  • Why: Required for NSQF-aligned certification, govt scheme participation, credibility
  • Process: Application → document review → physical inspection → approval (4–8 months)
  • Cost: Rs 2–5L (application + compliance setup)
  • Key requirements: Curriculum mapped to NSQF levels, qualified assessors, quality systems documented

NSQF Alignment

  • Map each course module to NSQF Levels 3–6
  • Develop Qualification Packs (QPs) aligned with existing National Occupational Standards (NOS)
  • Where QPs don't exist (e.g., Cloud/AI ops): work with SSCs to develop new QPs

State Registrations

  • Company registration: Section 8 (non-profit) or Private Limited (for-profit) — decision impacts tax, CSR eligibility, govt scheme access
  • Shops & Establishments Act: Register each center location
  • GST registration: 18% GST on commercial training; exempt for govt-funded programs
  • Professional Tax: State-specific, for employees
  • MSME registration: Udyam registration for benefits

Fire Safety & Building Compliance

  • Fire NOC for each center (mandatory before launch)
  • Building occupancy certificate verification
  • Accessibility compliance (RPWD Act 2016): ramps, accessible washrooms, signage

Phase 2: Year 2–3

  • Requirements: 5+ years operational track record, placement data, faculty qualifications, infrastructure
  • Benefits: Can award degrees (B.Voc, D.Voc), access to higher education funding, student loans
  • Strategy: Partner with an existing state Skill University as affiliated center (faster) while building track record for own application

B.Voc Degree Integration

  • Align curriculum with UGC B.Voc guidelines (multiple entry-exit, credit-based)
  • Partner with existing university for degree-granting (Year 3–4)
  • AICTE approval if offering engineering-adjacent programs

Phase 4: Year 7+

Deemed University Application

  • Requires: 10+ years of operation, significant research/innovation output, established reputation
  • Process: Apply to UGC → Expert Committee visit → MHRD consideration → Notification
  • Timeline: 2–5 years from application to approval
  • Alternative: Institutions of Eminence (IoE) recognition pathway for innovative models
  • Realistic assessment: This is a long-term aspiration, not a planning assumption
